Terms of Service Agreement

By accessing and/or using the Core Estimator ("the Service"), you ("the User") agree to be bound by these Terms of Service ("Agreement"). If you do not agree with these terms, please refrain from using the Service.

To use the Service, the User may be required to register for an account. The User agrees to provide accurate and complete information and to keep this information up to date.

We provide digital calibration tools and reference materials to assist Users in ensuring the accuracy and consistency of their project plans. This includes:

Calibration of Plans: Adjustment and alignment of 2D and 3D models to match specified dimensions and details. All data and information generated in Core Estimator from 2D and 3D files should be cross referenced and check against the original files provided to the User for accuracy and consistency.

Reference to PDF Plans: Use the original plans and documents for cross-verification of dimensions, details, and data in 2D plans and 3D models.

Data Consistency: Tools and services to compare and reconcile differences between data presented in 3D models and associated PDFs.

Verification: Users are responsible for verifying the accuracy of dimensions, details, and data between the 3D models and the PDF plans. Users must not rely solely on the tools and services provided but should perform manual checks to confirm consistency and accuracy.

Reporting Discrepancies: Users must report any discrepancies or errors found during verification to us promptly using the contact details provided in the Service.

Compliance with Guidelines: Users must adhere to any guidelines or instructions provided by us in relation to the use of the Services.

All intellectual property rights in the 3D models, PDF plans, and any other data or materials provided through our Services are owned by us or our licensors. Users are granted a limited, non-exclusive license to use the materials as part of the Services according to this Agreement.

Core Estimator Software Pty Ltd offers digital calculation services ("Services") that users may access and use for various purposes. These Services are subject to the terms of this agreement.

We continuously work to improve the Services and may perform upgrades from time to time. These upgrades may include, but are not limited to, enhancing features, improving user experience, and updating content. Changes to the Services may occur without prior notice, although we will endeavour to provide timely information about significant changes.

We strive to ensure that our Services are always available; however, there may be instances when the Services are interrupted, including, without limitation, for maintenance, upgrades, network or equipment failures, or other reasons beyond our control. We are not liable for any disruptions to our Services.

While we strive to provide accurate and error-free Services, we acknowledge that inaccuracies or errors may occur. The information and outputs provided by Core Estimator are based on the data and algorithms used at the time of calculation. We do not warrant the accuracy, completeness, or usefulness of the provided information and are not responsible for any errors, inaccuracies, or omissions in the contents provided.

You are responsible for ensuring that any information you input into Core Estimator is accurate. We are not liable for errors that arise from incorrect input data provided by users.

When utilising various sections of our construction estimating platform labelled as "beta," users must acknowledge that these components are still undergoing testing. While accessible for use, users should understand that the accuracy and consistency of these beta features may not be fully guaranteed. It is imperative for users to recognise that they may encounter bugs, errors, or inconsistencies that could affect their experience.

By accessing and using beta features, users accept that they do so at their own risk. Core Estimator Software Pty Ltd shall not be held liable for any consequences arising from the use of beta features, including but not limited to financial losses, project delays, or inaccuracies in estimates.

Users are encouraged to provide feedback and report any issues encountered while using beta features. This feedback will aid in the continuous improvement of our platform as we work towards the official release of these features.

Subject to this Agreement, Core Estimator Software Pty Ltd grants the User a limited, non-exclusive, non-transferable, and revocable license to use the Service for its intended purpose.

The User shall not:

- Reverse engineer, decompile, or disassemble the Service.

- Use the Service for any unlawful purpose.

- Resell or sublicense the Service without explicit permission from Core Estimator Software Pty Ltd.

Core Estimator Software Pty Ltd is offered under a subscription-based model. Subscription fees are billed in advance on a monthly or annual basis, as per the option chosen by you at the time of purchase and are non-refundable. This includes situations where you have decided to discontinue use during a subscription period.

If you are on a free trial and have provided your billing information, you will not be charged until the free trial has ended. If you decide to cancel before the free trial ends, there will be no charges made to your account.

Refunds will not be provided for any subscription. We do not provide credit, refunds, or prorated billing for subscriptions that are cancelled mid-month or mid-year. In such a circumstance, you will continue to have access to your subscription until the end of the billing cycle.

You are solely responsible for properly cancelling your account. You can cancel your account at any time by going to your account settings and following the cancellation procedures. If you cancel the service before the end of your current paid-up month or year, your cancellation will take effect immediately, and you will not be charged again, but you will not receive a refund for any portion of the fee paid for the current billing period.

If you choose to downgrade your service plan level, please be aware that no refunds will be provided for the difference in the subscription fee, and the new rate will take effect in the next billing cycle.

Core Estimator Software Pty Ltd reserves the right to modify, suspend, or discontinue the Service at any time for any reason with or without notice. Price changes and changes to your service plans will take effect following email notice to you.

Notwithstanding the above, certain refund requests for subscriptions may be considered by Core Estimator Software Pty Ltd on a case-by-case basis and granted at the sole discretion of Core Estimator Software Pty Ltd.

Core Estimator Software Pty Ltd reserves the right to terminate or suspend the User's access to the Service at any time, with or without cause or notice.

By using the Service, the User consents to the collection and use of certain information about the User, as specified in the Core Estimator Software Pty Ltd Privacy Policy.

The Service is provided "as-is" and "as available". Core Estimator Software Pty Ltd makes no warranties, either express or implied, regarding its accuracy, completeness, or performance.

To the maximum extent permitted by law, Core Estimator Software Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

This Agreement is governed by the laws of Australia without regard to its conflict of laws rules.

Core Estimator Software Pty Ltd reserves the right to modify or replace this Agreement at any time. It is the User's responsibility to review this Agreement periodically.
